LITIGATION IN STATE AND FEDERAL COURTS
GOLDFARB, STURMAN & AVERBACH's litigation department is staffed by attorneys with extensive trial experience in State and Federal Courts.
Our practice embraces virtually every significant area of civil litigation, including: commercial and contract litigation; insurance matters, including bad faith, coverage, appraisal of casualty and property loss (California Insurance Code §2071) and earthquake related claims (SB 1899/CCP §340.9); real estate litigation, including disputes involving purchase and sale of real property, leasehold disputes, commercial landlord-tenant, boundary line disputes, easement disputes, trust deed foreclosure (including actions for appointment of receiver and rent collection) and broker-salesperson matters; shareholder and partnership disputes; condominium association-homeowner disputes; construction, including representation of owners, general and sub-contractors, and construction defect litigation; personal injury matters; trade secret and unfair competition claims, including appropriate restraining orders and preliminary injunctions; environmental matters, including the defense of claims brought under California Proposition 65, leaking underground storage tank (LUST) matters, Emergency Planning and Community Right to Know Act matters (EPCRA) and the defense and prosecution of claims under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA aka "Superfund"), and under the Resource Conservation and Recovery Act (RCRA).
In connection with the firm's extensive probate and estate planning practice, the firm has developed a unique expertise in litigation matters related to probate litigation, contested wills and trusts.
Tax related actions for redetermination of Federal and State tax assessments, including jeopardy and sales tax assessments, criminal tax investigations, and claims and suits for refund of taxes are also handled by the firm.
While the focus of our litigation work is necessarily on preparing and trying cases, our litigation attorneys work closely with firm members in attempting to resolve disputes out of court.
